These Terms & Conditions govern your access to and use of Dr. Lyleth Nursing Prep and all related services. Please read them carefully before using our platform, and review our Privacy Policy to understand how we handle your data.

1. Acceptance of Terms

By accessing or using Dr. Lyleth Nursing Prep ("we," "us," or "our"), including our website, tutoring sessions, and any related services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Eligibility

To use our services, you must meet the following requirements:

  • You must be at least 18 years old, or have verifiable parental/guardian consent if under 18.
  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorized use of your account.

3. Services Provided

Dr. Lyleth Nursing Prep provides nursing education support services, which may include:

  • One-on-one subject tutoring with vetted independent contractor instructors.
  • Small group study sessions.
  • Structured NCLEX-PN preparation classes, including the NCLEX Intensive Review and the NCLEX Comprehensive Review.
  • Educational resources, recordings, and review materials.

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

4. Payments, Cancellations, and Refunds

All payments are processed securely through our third-party payment gateway, Stripe. By making a purchase, you agree to the following:

  • Pricing: All prices are listed in USD and are subject to change. You will be charged the price displayed at the time of booking.
  • Refund Policy: Refunds are available for sessions canceled at least 24 hours in advance. No-shows and late cancellations are non-refundable.
  • NCLEX Program Refunds: Fees for the NCLEX Intensive Review and NCLEX Comprehensive Review are non-refundable once the program has begun. If you cancel before the first scheduled session, you may request a full refund within 7 days of purchase. The NCLEX Comprehensive Review Pass Guarantee (Section 14) is a program-repeat guarantee, not a refund.
  • Chargebacks: Initiating a chargeback without first contacting us to resolve the issue may result in account suspension.

5. Student Conduct

To maintain a safe and productive learning environment, you agree not to:

  • Record, share, or distribute session content without explicit written permission.
  • Harass, threaten, or discriminate against instructors or other students.
  • Use our services for any unlawful purpose or in violation of academic integrity policies.
  • Attempt to circumvent, disable, or interfere with security features of the platform.

Violation of these rules may result in immediate termination of your account without refund.

6. Instructor Relationship

All instructors on the Dr. B Approved platform are independent contractors, not employees of Dr. Lyleth Nursing Prep. As such:

  • Instructors set their own availability, rates, and teaching methods within platform guidelines.
  • We are not responsible for the independent actions or omissions of instructors outside of scheduled sessions.
  • All instructors are bound by strict confidentiality agreements regarding student data.

7. Intellectual Property

All content provided through our services — including session recordings, study materials, branding, and website content — is the property of Dr. Lyleth Nursing Prep or its licensors and is protected by copyright and trademark law.

  • You may not reproduce, distribute, or create derivative works without written permission.
  • Your personal session recordings are available for your own educational review only.
  • Any feedback or suggestions you provide may be used by us without compensation.

8. Disclaimers

Our services are provided on an "as is" and "as available" basis. Except for the NCLEX Comprehensive Review Pass Guarantee described in Section 14, we do not guarantee:

  • A specific score, grade, or outcome on any exam or course.
  • Uninterrupted, error-free, or secure access to our platform.
  • That any instructor will be available at your preferred time.

You acknowledge that nursing education and test preparation results depend on many factors outside our control, including your own effort and study habits. The Pass Guarantee is the sole exception to this section and is governed exclusively by its own terms.

9. Limitation of Liability

To the maximum extent permitted by law, Dr. Lyleth Nursing Prep shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if you violate these Terms & Conditions or engage in conduct harmful to our platform, instructors, or other students.

11. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the United States and the state in which Dr. Lyleth Nursing Prep operates, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right to modify these Terms & Conditions at any time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the revised terms.

13. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to the practices described in the Privacy Policy.

14. NCLEX Comprehensive Review Pass Guarantee

Students who enroll in the NCLEX Comprehensive Review ("Comprehensive Review") may be eligible for our Pass Guarantee. If you complete the program and do not pass the NCLEX-PN, you may repeat the Comprehensive Review once at no additional tuition cost, subject to the conditions below. The Pass Guarantee is a program-repeat guarantee, not a refund.

  • Eligible program: The Pass Guarantee applies only to the NCLEX Comprehensive Review. It does not apply to 1-on-1 tutoring, the NCLEX Intensive Review, or any other service.
  • Definition of pass: For purposes of this guarantee, "pass" means an official "Pass" result on the NCLEX-PN administered by the National Council of State Boards of Nursing (NCSBN) or the applicable state board of nursing. Practice test scores, mock exam results, and instructor assessments do not determine eligibility.
  • Eligibility requirements: To qualify, you must: (a) attend at least 90% of scheduled live sessions; (b) complete all assigned practice tests, mock exams, and the comprehensive post-test; (c) attend all included 1-on-1 progress and readiness sessions; and (d) sit for the NCLEX-PN within six (6) months of completing the program.
  • How to claim: To claim the Pass Guarantee, email us at contact@drlylethnursingprep.com within thirty (30) days of receiving your official NCLEX-PN result, including your full name, program cohort, and a copy of your official result notice. We will verify eligibility and schedule your repeat program.
  • What the guarantee provides: Eligible students may repeat the NCLEX Comprehensive Review one time at no additional tuition cost. The guarantee does not cover exam fees, study materials purchased separately, travel, or any other costs.
  • Exclusions: The Pass Guarantee does not apply if you: (a) miss more than 10% of live sessions without prior approval; (b) fail to complete required assessments; (c) fail to sit for the NCLEX-PN within the six-month window; (d) violate our Student Conduct policy; or (e) have already used the guarantee once.
  • Limitation: The Pass Guarantee is limited to one repeat enrollment per student and is non-transferable. It has no cash value and cannot be exchanged for a refund or credit toward other services.
  • Changes: We reserve the right to modify or discontinue the Pass Guarantee for future enrollments. The terms in effect at the time of your purchase apply to your enrollment.

This section is the complete and exclusive statement of the Pass Guarantee. No instructor, employee, or representative is authorized to modify these terms verbally or in writing outside of this section.
